TennACE Court: Terms and conditions

1. BINDING AGREEMENT & INTERPRETATION
By accessing the TennACE Court website, completing a purchase via Shopify, or entering our facility, you ("the Customer") enter into a legally binding contract with TennACE Court Limited ("the Company").
Final Authority Clause: In the event of any dispute, claim, or interpretation regarding these Terms and Conditions, the use of the facility, or booking policies, TennACE Court Limited reserves the sole and final right of interpretation and decision. Our decision shall be final and binding on all parties.
2. COMPREHENSIVE WAIVER OF LIABILITY
YOU ACKNOWLEDGE THAT TENNIS IS A HIGH-INTENSITY SPORT WITH INHERENT RISKS. To the maximum extent permitted by the laws of the Hong Kong SAR, you hereby waive, release, and discharge TennACE Court Limited from any liability for:

Physical Harm: Death, personal injury, or illness (including cardiac events or respiratory issues) arising from the use of the courts or training equipment.

Premises Risks: Slips, trips, or falls caused by court surfaces, stray balls, or moisture.

Equipment Failure: Injuries caused by the malfunction of automated ball machines, netting, or lighting systems.

Third-Party Actions: Harm caused by other users, including unauthorized entrants or "tailgaters."
3. PROPERTY & THEFT EXCLUSION
TennACE Court Limited provides an automated, often unstaffed environment. We are not responsible for the loss, theft, or damage of any personal property (including rackets, bags, electronics, or vehicles parked nearby). Use of the provided storage areas is at your own risk.
4. INDEMNIFICATION (Customer’s Financial Liability)
You agree to defend and hold TennACE Court Limited harmless against any financial loss or legal claims arising from:

Damage to Property: You will be held 100% financially liable for any damage to ball machines, air conditioning units, or court infrastructure caused by misuse or negligence.

Guest Liability: You assume full responsibility for any guests or minors you bring into the facility. If your guest sues the Company, you agree to pay for our legal defense and any resulting settlements.
5. OPERATIONAL RULES & SECURITY

Access Control: Entry is via a unique QR code. Sharing this code or allowing "tailgaters" to enter is a material breach of this contract and will result in an immediate ban without refund.

Video Surveillance: The facility is monitored 24/7 by CCTV with audio recording. This data is used for security and liability verification.

Professional Coaching: Private coaching for profit by unauthorized individuals is strictly prohibited. We reserve the right to terminate any session where unauthorized commercial activity is suspected.
6. BOOKINGS, CANCELLATIONS & FORCE MAJEURE

Finality of Sales: All payments made via Shopify are final.

Weather & Acts of God: In the event of a Typhoon Signal No. 8 or Black Rainstorm, the facility may close. We will provide a rescheduling credit, but no cash refunds.

Technical Outages: We are not liable for inability to access the facility due to internet outages, power failures, or Shopify system maintenance.
7. EQUIPMENT SPECIFIC RULES

Ball Machines: Must only be used with the tennis balls provided by the Company. Use of external balls or foreign objects in the machine will be treated as equipment tampering.

Court Maintenance: Players must stop play 2 minutes before the end of their session to clear the court of balls.
8. DATA PRIVACY
Your use of our digital store is supported by Shopify. You acknowledge that your data will be processed according to our Privacy Policy and Shopify’s global data standards. TennACE Court Limited is not liable for data breaches occurring on third-party platforms.
9. SEVERABILITY & GOVERNING LAW
If any part of this agreement is found to be unenforceable by a Hong Kong court, all other parts shall remain in full force. This agreement is governed by the laws of the Hong Kong Special Administrative Region.
